2. Scope
These Terms and Conditions (“Terms”) apply to all offers, orders, and purchases made through our website www.dhyeres.com, operated by D’HYÈRES.
By accessing or using our website and/or purchasing products from us, you agree to be bound by these Terms, including any additional policies referenced herein or available by hyperlink.
These Terms are governed by Dutch law and the mandatory consumer protection provisions of the European Union.
3. Products and Services
D’HYÈRES sells earrings and related jewelry accessories.
We take great care to display our products accurately but cannot guarantee that colors and materials shown on your screen exactly represent the physical items.
All products are subject to availability. Prices are listed in euros (€) and include VAT unless otherwise stated.
We reserve the right to modify products, descriptions, or prices at any time without notice.
4. Orders and Payment
Orders can be placed exclusively through our website using the available payment methods.
All payments are processed securely via Shopify Payments or other authorized payment providers on behalf of D'HYÈRES.
We reserve the right to cancel or refuse any order if fraud, error, or irregular activity is suspected.
Ownership of goods transfers to you once full payment is received; risk transfers upon delivery.
5. Delivery
We deliver within the Netherlands and other EU member states.
Delivery times shown on the website are estimates only. We are not liable for delays caused by carriers or customs.
If an item cannot be delivered, we will notify you and provide a refund or alternative solution.
6. Right of Withdrawal (EU Consumers)
Under EU and Dutch consumer law, you have the right to withdraw from your purchase within 14 days after receiving your order, without giving a reason.
To exercise this right, you must notify us by email at info@dhyeres.com before the withdrawal period expires or by selecting this option.
You must return the goods to us within 14 days after notifying us of your withdrawal.
Returned items must be unworn, undamaged, and in their original packaging (pouch and box).
You are responsible for the direct cost of returning the goods.
We will reimburse all payments received (including standard delivery costs, if any) within 14 days of receiving the returned goods or proof of shipment, using the same payment method used for purchase.
Condition of returned goods:
If the returned item shows signs of use, wear, or damage, we may deduct any reduction in value from your refund in accordance with Article 6:230s(3) of the Dutch Civil Code.
7. Legal Warranty (Garantie)
All products sold by D’HYÈRES are covered by the legal warranty (wettelijke garantie) under Dutch and EU law.
This means that the product must meet reasonable expectations for normal use.
If an item is defective or develops a fault within a reasonable time after purchase (normally six months, unless proven otherwise), we will repair, replace, or refund the item at no cost.
Damage resulting from misuse, improper care, or normal wear and tear is not covered by the warranty.
To report a defect, contact info@dhyeres.com with your order number and a clear photo of the issue.
8. Returns Policy (Extended Store Policy)
In addition to the statutory 14-day right of withdrawal, D’HYÈRES offers an extended 100-day goodwill return policy for unworn and undamaged earrings in their original packaging.
Items returned after the 14-day legal period will be refunded as store credit.
We cannot accept returns of worn, damaged, or altered items.
9. Prices and Taxes
All prices are in euros (€) and include Dutch VAT (21%).
Shipping costs are displayed at checkout.
For deliveries outside the Netherlands, you are responsible for any import duties or local taxes applicable in your country.
10. Accuracy of Information
We strive to ensure that all product descriptions, prices, and availability details are correct.
If we discover an error after you place an order, we will inform you and offer the option to reconfirm or cancel your purchase.
We reserve the right to correct errors or update information at any time without prior notice.
11. Intellectual Property
All content on this website—including text, photographs, design, trademarks, and logos—is the property of D’HYÈRES or its licensors and is protected by copyright and trademark law.
No part of this site may be reproduced, distributed, or used commercially without prior written consent.

If you are a consumer residing in the EU, you also benefit from the mandatory consumer protections of your country of residence.
Any disputes will be submitted to the competent court in Amsterdam, The Netherlands, unless otherwise required by law.
